Welcome to ShotsFlowAI. These Terms of Service ("Terms") govern your use of our AI-powered product photography service. By creating an account or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ShotsFlowAI ("Service," "Platform," or "we"), you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Kamil Kwapisz Consulting (NIP/TAX ID: 7010988206), a business operating in Poland, European Union.

2. Service Description

ShotsFlowAI provides an AI-powered product photography service that allows users to:

  • Upload product images
  • Generate AI-enhanced variations of product photos
  • Apply various styles and settings to images
  • Download generated images for commercial or personal use

The Service uses third-party AI models to generate images based on your inputs. Results may vary and are not guaranteed to meet specific expectations.

3. Account Requirements

3.1 Eligibility

You must be at least 18 years old to use this Service. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3.2 Account Registration

To access most features, you must create an account by providing a valid email address and password. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.3 One Account Policy

Each user may maintain only one active account. Creating multiple accounts to abuse free credits or circumvent restrictions is prohibited and may result in termination of all associated accounts.

4. Acceptable Use Policy

4.1 Permitted Use

You may use our Service to generate product photography for legitimate commercial or personal purposes, subject to these Terms.

4.2 Prohibited Content

You agree not to upload, generate, or attempt to generate content that:

  • Is illegal: Violates any applicable law or regulation
  • Infringes rights: Violates intellectual property, trademark, or other proprietary rights of third parties
  • Is harmful: Promotes violence, harassment, discrimination, or hatred
  • Is explicit: Contains pornographic, sexually explicit, or obscene material
  • Is deceptive: Creates misleading deepfakes or fraudulent content
  • Is dangerous: Depicts weapons, drugs, or other regulated items in violation of applicable laws
  • Violates privacy: Contains personal information of others without consent

4.3 Prohibited Activities

You agree not to:

  • Use automated tools, bots, or scripts to access the Service without authorization
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with or disrupt the Service or servers
  • Circumvent any access controls, rate limits, or security measures
  • Resell, redistribute, or sublicense access to the Service without permission
  • Use the Service in any way that violates the terms of our AI model providers

5. Intellectual Property

5.1 Your Content

You retain all ownership rights to the images you upload to our Service. By uploading content, you represent and warrant that:

  • You own or have the necessary rights to use the uploaded images
  • Your content does not infringe on any third party's intellectual property rights
  • You have obtained any necessary permissions or releases

5.2 Generated Content

Subject to these Terms and applicable law, you own the AI-generated images created through our Service based on your inputs. You may use generated images for commercial or personal purposes.

You grant us a limited, non-exclusive license to:

  • Process and store your content as necessary to provide the Service
  • Display thumbnails of generated images in your account dashboard
  • Create anonymized, aggregated data to improve our Service

5.3 AI Output Disclaimer

AI-generated content may occasionally produce unexpected or imperfect results. We do not guarantee that generated images will meet specific quality standards, be free of artifacts, or accurately reflect your intended output.

5.4 Platform Intellectual Property

All rights, title, and interest in the ShotsFlowAI platform, including its design, branding, software, and underlying technology, remain the exclusive property of Kamil Kwapisz Consulting. These Terms do not grant you any rights to our trademarks, logos, or other proprietary materials.

6. Credits and Payments

6.1 Credit System

Our Service operates on a credit-based system. Different AI models consume different amounts of credits per generation:

  • Credit costs vary by model and are displayed before generation
  • Credits are deducted when image generation begins
  • Failed generations due to system errors may be refunded at our discretion

6.2 Free Plan

New accounts receive complimentary credits to test the Service. Free credits are:

  • Non-transferable between accounts
  • Subject to usage limitations
  • May be modified or discontinued at any time

6.3 Paid Subscriptions

Paid subscriptions provide monthly credit allocations. Subscription terms:

  • Subscriptions are billed monthly in advance
  • Monthly credits do not roll over to the next billing period
  • Prices are displayed in the currency indicated at checkout
  • You may cancel your subscription at any time from your account settings

6.4 Payment Processing

Payments are processed by Polar, our third-party payment processor. By making a purchase, you agree to Polar's terms of service. We do not store your payment card details.

6.5 Refund Policy

Due to the nature of digital services and AI-generated content:

  • Credits are generally non-refundable once purchased
  • Subscription fees are non-refundable for the current billing period
  • We may offer refunds at our sole discretion for technical issues or billing errors

EU Consumer Rights: If you are a consumer in the European Union, you have a 14-day right of withdrawal for digital services, unless you have expressly consented to the service starting immediately and acknowledged that you lose your withdrawal right once the service begins.

7. Service Availability

7.1 No Uptime Guarantee

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Emergency repairs or updates
  • Third-party service outages (AI providers, hosting, etc.)
  • Circumstances beyond our reasonable control

7.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes in advance.

8. Limitation of Liability

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • We shall not be liable for any loss of profits, data, goodwill, or other intangible losses
  • Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim

8.3 Consumer Rights

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or breach of statutory consumer rights.

9. Indemnification

You agree to indemnify and hold harmless Kamil Kwapisz Consulting and any affiliates from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or generate through the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

  • Canceling your subscription (if applicable)
  • Contacting us to request account deletion

10.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • We are required to do so by law
  • We detect fraudulent or abusive activity
  • We discontinue the Service

10.3 Effect of Termination

Upon termination:

  • Your right to access the Service will cease immediately
  • We may delete your account data after a reasonable retention period
  • Sections of these Terms that should survive termination will remain in effect
  • No refunds will be provided for unused credits or subscription periods

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles.

11.2 Jurisdiction

For business users, any disputes shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.

11.3 EU Consumer Rights

If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence. Nothing in these Terms affects your rights under mandatory consumer protection laws in your jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms with a new "Last updated" date

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
